General terms and conditions

1. Scope

For all orders via our online store by consumers and entrepreneurs, the following terms and conditions apply.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

With respect to entrepreneurs, these GTC shall also apply to future business relations without our having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they shall only become part of the contract if we have expressly agreed to them.

2. Contracting party, conclusion of contract

The purchase contract is concluded with Yourvanstore.

By placing the products in the online store, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

3. Contract language, contract text storage

The language available for the conclusion of the contract is German. We save the text of the contract and send you the order data and our GTC by e-mail. You can view the contract text in our customer login.

4. Collection and delivery

Shipping costs will be added to the indicated product prices. You can find out more about the amount of shipping costs in the offers.

Customers have the option to pick up their ordered product in our store. In the order process, the customer is offered the option "Free pickup in Veghel - Netherlands". This will not incur any additional costs to the invoice amount.

5. Payment

In our store you can basically use the following payment methods:

Sofort ( Multisafepay )
After placing your order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort, identify yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the order process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Giropay ( Multisafepay )
If you decide to pay with giropay, you will be securely directed to the online banking of your bank or savings bank after entering your bank code. Here you log in as usual with your access data. After successful login, a pre-filled bank transfer is automatically displayed, which already contains all details of the purchase: Invoice amount, reason for payment and bank details of the merchant. By entering a TAN you authorize the transfer. Immediately after successful transfer we receive a payment guarantee from your bank and can ship the goods immediately according to availability.

Bank transfer ( Multisafepay )
If you choose the payment method bank transfer, Yourvanstore will give the client his bank details in the order confirmation and will deliver the goods after receipt of payment.

Credit card Visa & Mastercard ( Multisafepay )
The information is encrypted using SSL technology. We contact your credit card provider to execute a secure transaction. Your credit card organization may ask you for your 3D security code.

In the order process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data and confirm the payment instruction to us. After submitting the order in the store, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. You will receive further instructions during the order process.

6. Retention of title

The goods remain our property until full payment. For entrepreneurs, the following shall apply in addition: We shall retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from this resale - irrespective of any combination or mixing of the goods subject to retention of title with a new item - in the amount of the invoice amount, and we accept this assignment. You shall remain authorized to collect the claims, but we may also collect claims ourselves insofar as you do not meet your payment obligations.

7. Warranty and guarantees

The statutory defect liability law applies. Information on any applicable additional warranties and their exact terms can be found with the product and on the warranty page on the website.

8. Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken or has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (Yourvanstore, Huygensweg 12, 5482TG Schijndel, The Netherlands, https://info@yourvanstore.com%2C/ +49 (0)220 3983 3012) by means of a clear declaration (e.g. a letter or e-mail sent by post) of your decision to withdraw from this contract. For this purpose, you can use the enclosed model withdrawal form, which is, however, not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation
If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. For goods that cannot be returned normally by mail due to their nature, these costs amount to 25,- EUR.
You must pay for any loss in value of the goods only if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

The right of withdrawal does not apply to the following contracts:

Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.

Our voluntary right of return
In addition to your legal rights, we offer the following voluntary return guarantee: You can return products you have ordered from Yourvanstore to Yourvanstore within 14 days of receipt of the goods. To return goods, please use our returns form by going to the Returns page and clicking the "Request a Return" button at the bottom of the page. If you return merchandise in accordance with this voluntary return policy and with the return shipping label we send you, we will refund the purchase price excl. shipping costs of your original purchase. You will bear the direct cost of returning the goods. For goods that cannot be returned normally by mail due to their nature, these costs will be 25,- EUR. This voluntary right of return does not limit your statutory rights and therefore your right of withdrawal as described above.

9. Liability

For claims based on damages caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation

in case of injury to life, body or health,
in case of intentional or grossly negligent breach of duty,
in the case of warranty promises, insofar as agreed, or
insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

We are willing to participate in an out-of-court arbitration procedure before a consumer arbitration board.
